TERMS AND CONDITIONS OF USE OF THE APPLICATION

These Terms and Conditions govern the download, access, and use of the mobile application TRACKING RESA EXPO (hereinafter, the “Application”), provided by RESA LOGISTIC, S.L. (“RESA LOGISTIC”) to users. By downloading and using the Application, the user agrees to be bound by these Terms and Conditions.

This version of the Application is offered free of charge. The user acknowledges and accepts that the acquisition, download, and updating of the Application are subject to these Terms and Conditions.

Accessing the Application implies full and unconditional acceptance of these Terms and Conditions.

1. PURPOSE

The purpose of the Application is to facilitate user access to RESA LOGISTIC’s services.

The Application has been designed for use by various stakeholders, including logistics agents, clients, event organizers, and contractors, among others. Its design and development involved industry specialists and a group of test users during the pilot phase.

The Application is made available exclusively for professional and business use.

It is compatible with mobile devices running Android or iOS operating systems, as well as with computers.

2. FEATURES

Registered users will have access only to their own data and information related to the services they have requested.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

All intellectual and industrial property rights in the Application belong to RESA LOGISTIC, which retains the exclusive right to exploit them in any form, including reproduction, distribution, public communication, and transformation.

Third parties holding intellectual and industrial property rights in photographs, logos, or other content incorporated into the Application have duly authorized their reproduction, distribution, and public availability.

The user acknowledges that any reproduction, modification, distribution, commercialization, decompilation, reverse engineering, or any other action intended to obtain the source code, or the disclosure of unauthorized reference testing results concerning any elements or utilities integrated in the Application, constitutes an infringement of RESA LOGISTIC’s intellectual property rights. The user therefore undertakes to refrain from engaging in any such activities.

4. PRIVACY POLICY

Controller of personal data:

RESA LOGISTIC, S.L. is the controller of the user’s personal data and processes such data in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

Purpose of processing:

Personal data are processed for the purposes described in Section 1 (“Purpose”) of these Terms and Conditions, namely to provide the user with access to RESA LOGISTIC’s services. This may include, without limitation, details such as: Type of service; Exhibiting company name; Assembly company name; Stand location; Service dates and times.

Legal basis for processing:

• performance of a contract to which the user is a party, or steps taken at the user’s request prior to entering into a contract (Article 6.1(b) GDPR);
• RESA LOGISTIC’s legitimate interest in responding to inquiries or requests submitted through the forms or contact channels provided in the Application (Article 6.1(f) GDPR).

Data retention:

Personal data will be retained only for as long as necessary to fulfill the purpose for which they were collected, i.e., for the duration of the contractual relationship arising from the use of the Application (including any statutory retention obligations). Once no longer required, the data will be securely erased or anonymized.

Data disclosure:

• Competent public authorities, where required by applicable law;
• Service providers engaged to deliver services through the Application, provided they are bound by confidentiality and data processing agreements in accordance with Article 28.3 GDPR;
• Providers requiring access to user data to operate electronic services (application, website, or email), under confidentiality and data processing agreements signed with RESA LOGISTIC.

User rights:

• Access, rectify, port, and erase their data;
• Restrict or object to processing;
• Lodge a complaint with the supervisory authority (www.aepd.es) if they believe their data have been processed unlawfully.

5. MANDATORY INFORMATION PROVIDED BY THE USER

By selecting the relevant checkboxes and completing fields marked with an asterisk (*) in the Application forms, users expressly, freely, and unequivocally consent to the processing of their personal data for the purpose of handling their requests. The inclusion of other data in non-mandatory fields is voluntary. Users guarantee that all personal data provided to RESA LOGISTIC are accurate and undertake to notify any changes.

RESA LOGISTIC informs users that all requested data are mandatory, as they are essential for the proper provision of services. Failure to provide such data may result in services or information being incomplete or unsuitable for the user’s needs.

6. SECURITY MEASURES

RESA LOGISTIC complies with GDPR and LOPDGDD requirements in the processing of personal data, particularly the principles set forth in Article 5 GDPR. Data are processed lawfully, fairly, and transparently, and are adequate, relevant, and limited to what is necessary for their intended purposes.

RESA LOGISTIC has implemented appropriate technical and organizational measures to safeguard users’ rights and freedoms and has communicated the relevant information to enable users to exercise them.

All information transmitted by the Application to cloud servers (owned or third-party) is encrypted and secured via HTTPS, ensuring that data cannot be intercepted.

7. DISCLAIMER

RESA LOGISTIC reserves the right to edit, update, modify, suspend, remove, or terminate the services provided through the Application, including its content, at any time and without prior notice, as well as to change the form or manner of access.

Such modifications may arise from legislative updates, technical changes to the Application, industry standards, or strategic and corporate reasons.

RESA LOGISTIC shall not be liable for use of the Application by minors; downloading and using the Application is solely the responsibility of the user.

The Application is provided “as is” without warranties of any kind. RESA LOGISTIC does not warrant the quality of the Application or its fitness for all intended purposes. While RESA LOGISTIC will make reasonable efforts to improve the Application’s quality, it does not guarantee the accuracy or timeliness of its content.

The user bears sole responsibility for use of the Application. Except as expressly stated in these Terms and Conditions, RESA LOGISTIC shall not be liable for any loss or damage arising from the download or use of the Application, including but not limited to malfunctions, failures, or interruptions (e.g., communication line errors, hardware or software defects, or Internet failures). RESA LOGISTIC is likewise not responsible for damages resulting from improper or inappropriate use of the Application.

8. GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by the laws of Spain. The parties submit to the jurisdiction of the Courts and Tribunals of Barcelona, expressly waiving any other jurisdiction that may otherwise apply.
